Note on protected health information (PHI): Personal Information you provide as a patient through our patient portal, intake forms, or in the course of treatment is protected health information governed by HIPAA and our Notice of Privacy Practices, which describes how we use and disclose your health information and your rights regarding it. This website Privacy Policy governs information collected through our public website and marketing, not PHI handled under HIPAA.

What Personal Information We Collect

We collect various types of information depending on how you interact with us and what products or services you use.

Personal Information you provide to us

If you fill out a form on our website — such as requesting an appointment, signing up for our newsletter or eBook, or registering for an event — we collect and process that information to provide you with the communication, products or services. This may include your name, email address, phone number, physical address, and payment and billing information.

Personal Information collected when you visit our website

When you use our website, we may automatically collect Personal Information such as IP address, user-agent information (sent by your web browser, which may include device type), and information collected by cookies and similar technologies. Personal Information collected when you use our products or services

When you use our products and services, we may collect:

  • Date of birth / age

  • Health and medical information you provide as part of intake, assessment, and treatment

  • Patient portal account credentials (username)

We may also collect usage data regarding your use of our website and services, which may contain Personal Information. We collect payment and billing information when you register for products, programs, or events; we use this solely to process payments and deliver our products and services.

Sensitive personal information: As a healthcare provider, we collect health information, and we may collect government-issued identification. We collect such information with your consent and/or as necessary to provide healthcare services, and we handle patient health information in accordance with HIPAA.

Unless otherwise noted in this policy, we act as the “controller” of personal data that we collect and process.

How We Collect Information

We collect Personal Information from you when you visit our website, contact us, become a patient, or use our products and services. Some information is provided directly by you (website forms, patient intake forms, the patient portal, phone, email, or in person) and some is collected automatically (cookies and similar technologies when you use our website).

We collect most Personal Information directly from you. As part of providing treatment and obtaining payment for services, we may also receive health information from other healthcare providers, laboratories, insurers, and individuals involved in your care, as described in our HIPAA Notice of Privacy Practices.

How We Use Your Information

We process your personal information for the following purposes:

  • To provide our medical, telehealth, and wellness services.
  • To schedule, confirm, and remind you of appointments (including by text message, with your consent).
  • To respond to your requests for information.
  • To contact you with updates about our services.
  • To market and advertise our services, including sending marketing communications, with your consent.
  • To process payments and fulfill orders for products, supplements, and programs.
  • To analyze and improve our website and services.
  • To comply with legal and regulatory obligations.

The Legal Basis for Collecting and Processing Information

We use the following legal bases for collecting and processing Personal Information:

  • Consent — e.g., when you subscribe to our newsletter, opt in to text messages, request information, or where we process health information for non-treatment purposes.
  • Contract — to provide the services you have requested or purchased.
  • Legal obligation — to comply with applicable laws, including medical recordkeeping requirements.
  • Legitimate interests — such as marketing, website analytics, and securing our systems, where not overridden by your rights.

How We Share Information

We share Personal Information with service providers and partners as needed to operate our business and provide our services. These include, by category:

  • Electronic health record / patient portal provider (MD HQ) — to manage patient records and the portal.
  • Email and SMS messaging platform (ActiveCampaign) — to send communications you have consented to.
  • Payment processors — where you make a payment, a third-party payment processor handles the transaction; we do not store full card details ourselves.
  • Supplement dispensary (Fullscript) — when you order supplements through our store.
  • Consent management platform (Osano) — manages your cookie/tracking consent and acts as the gate that determines which analytics and advertising tools are permitted to load.
  • Healthcare data governance platform (Freshpaint) — loads only after you grant analytics/advertising consent through Osano, and strips out personal and health information before any data is passed to analytics or advertising tools.
  • Analytics and advertising providers (Google Analytics / Google Ads, Meta/Facebook) — for website analytics and advertising, and only after consent (via Osano) and removal of personal/health information (via Freshpaint).
  • Website hosting and infrastructure providers — to host and operate our website.
  • Healthcare providers, laboratories, and testing partners involved in your care — as part of providing treatment. Our use and disclosure of patient health information for treatment, payment, and healthcare operations is described in our HIPAA Notice of Privacy Practices.
  • Professional advisors — accountants and similar vendors.

Our vendors and service providers are not permitted to use your personal information for any purpose other than to provide contracted services. Vendors are not permitted to use your personal information for their own marketing, and are not permitted to share your information for marketing purposes. We do not sell your personal information.

We may share personal information in response to a legal summons or subpoena, or if required by law enforcement agencies.

 

SMS / Text Messaging (Mobile Information)

Rezilir Health® offers text (SMS) messaging. When you opt in to receive text messages from us, the following applies:

  • Program description. We send text messages for purposes such as appointment scheduling, confirmations, and reminders; account and service updates; and replies to communications you send us — for example, an automated text reply if we are unable to answer your call (missed-call text back).
  • Consent. You will only receive text messages after you provide consent — for example, by checking a clearly labeled, unchecked consent box, by providing your mobile number for appointment reminders when you become a patient, or by contacting us first (such as calling or texting us, in which case we may respond by text). Consent to receive text messages is not a condition of purchasing any goods or services.
  • Message frequency. Message frequency varies.
  • Cost. Message and data rates may apply, depending on your mobile carrier and plan.
  • Opt-out. You can cancel at any time by replying STOP to any message. After you send STOP, we will send a confirmation message and stop sending text messages. To opt back in, enroll again as you did the first time.
  • Help. For help, reply HELP or contact us at 786-442-1932 or therezilirway@rezilirhealth.com.
  • Carriers. Mobile carriers are not liable for delayed or undelivered messages.

No mobile information — including your phone number and any data related to your enrollment in our SMS/text messaging program — will be shared with third parties or affiliates for their marketing or promotional purposes. Mobile opt-in information may be shared only with subcontractors that support the messaging program (such as our SMS platform provider, ActiveCampaign), solely to deliver the service on our behalf, and these parties are prohibited from using it for their own purposes. We do not sell your mobile information.

How Long We Retain Your Information

How long we keep Personal Information depends on the type of information and the purpose for which it was collected. After a reasonable period or the completion of the purpose for which it was collected, we will delete or anonymize it.

We retain patient medical records for the period required by Florida law and applicable medical recordkeeping regulations. For marketing data (such as newsletter subscriptions), we retain your information until you unsubscribe and for a reasonable period thereafter. Specific retention periods are determined by the type of information, the purpose for which it was collected, and applicable legal requirements. 

We retain Personal Information where we have an ongoing legitimate business purpose, for example to resolve disputes or comply with legal obligations.

Cookies and Other Tracking Technologies

Cookies are small files stored on your web browser when you visit our website. Some last only while you are on the site; others (“persistent cookies”) are stored longer. Cookies collect information such as your IP address, browser settings, and how you use the website, and your general location may be estimated from your IP address. Some cookies track activity to deliver personalized advertising on our site and others; we use Google Analytics, Google Ads, and the Meta (Facebook) pixel for analytics and advertising.

We use Osano, a consent management platform, as the gate for all non-essential cookies and tracking technologies. These technologies load only after you provide consent through our Osano cookie banner, and we honor “Do Not Track” and Global Privacy Control (GPC) browser signals. When you enable analytics and/or advertising consent, we use Freshpaint, a healthcare-focused data-governance platform that loads only after that consent is given. Freshpaint strips out personal and health information before any data is passed to the analytics or advertising platforms you have consented to through Osano (such as Google Analytics, Google Ads, and the Meta pixel). You may also change your browser settings to reject or delete cookies, and find more information about opting out of interest-based advertising at www.cookiesandyou.com.

We use Google Analytics Advertiser Features, including Remarketing, Google Display Network Impression Reporting, Google Marketing Platform (DoubleClick) integrations, and Google Analytics Demographics and Interest Reporting. These features load only after you provide consent through Osano, and the data shared is anonymized by Freshpaint before it reaches Google. We and third-party vendors use first-party cookies (such as the Google Analytics cookie) and third-party cookies together to serve and optimize advertising based on your prior visits to our website. You can opt out of Google’s use of cookies through Google Ad Settings (adssettings.google.com) and opt out of third-party vendors’ use of cookies through the Network Advertising Initiative opt-out page (optout.networkadvertising.org).

We abide by Meta’s (Facebook’s) advertising data use restrictions and do not transfer advertising data to data brokers or other advertising networks.

  • The Right to Opt Out of Sale/Sharing — you control whether data is shared with advertising tools through our Osano consent banner, and we honor GPC signals. Personal and health information is stripped by Freshpaint before any data reaches Google or Meta.
  • The Right to Limit Use of Sensitive Personal Information.
  • The Right to Non-Discrimination.

We do not sell Personal Information to third parties (pursuant to California Civil Code Sections 1798.100–1798.99).

International Data Transfers

Personal Information may be transferred from users residing in the EU/EEA, Switzerland, or the UK to our servers, partners, or vendors located in the United States, where there may not be an adequacy decision. When we transfer such Personal Information to the US, we make use of the EU Standard Contractual Clauses and the UK Addendum, together with additional safeguards where appropriate. Security

We take all reasonable steps to protect the information we receive from you from accidental or unlawful destruction, loss, alteration, and unauthorized disclosure or access, including appropriate physical, technical, and administrative measures. As a healthcare provider, we maintain safeguards consistent with HIPAA for protected health information. No security measures are perfect, and the risk of a data breach is possible.

We manage consent for cookies and tracking through Osano, our consent management platform. Non-essential cookies and tracking technologies load only after you provide consent, and we honor “Do Not Track” and Global Privacy Control (GPC) browser signals.

Once you provide consent, your website activity is processed through Freshpaint, a healthcare privacy platform that operates under a signed Business Associate Agreement (BAA). Freshpaint applies server-side governance that filters data before it is shared with any third-party analytics or advertising tool. Using configurable allowlists and blocklists, Freshpaint is designed to remove protected health information — including the categories of identifiers defined under HIPAA — and to mask or hash user identifiers before data is sent to tools that are not covered by a BAA (such as Google Analytics, Google Ads, and Meta). As a result, those advertising and analytics platforms receive only anonymized, non-PHI data, while contact information is shared only with systems that are covered by a signed BAA, such as our CRM. This “safe by default” approach is intended to prevent personal and health information from being shared with tools that are not authorized to receive it.

We enter into Business Associate Agreements with vendors that handle protected health information, and our vendors are contractually limited to using your information only to provide their services to us.

Automated Decision Making and Profiling

We do not make decisions that produce legal or similarly significant effects about you based solely on automated processing, and we do not use profiling for such decisions. Our clinicians are involved in decisions about your care. 

Children’s Privacy

Our services are intended for adults. We do not provide services to, or knowingly collect personal information from, children. We do not knowingly collect or solicit personal information from children under age 13 (or under age 16 for EU/UK residents). If we learn that we have collected personal information from a child, we will delete it. If you believe a child may have provided us with personal information, please contact us.

Third-Party Links

Our website may contain links to other websites and to products or services offered by third parties. We do not control those sites, and any information you provide to them is governed by their own privacy policies. We encourage you to review the privacy policy of any third-party website you visit.

Sensitive Information

As a healthcare provider, we collect health information and may collect government-issued identification. We collect, use, and share this sensitive information only as necessary to provide healthcare services, with your consent, or as required or permitted by law, and we handle patient health information in accordance with HIPAA. Outside of the patient relationship, we ask that you not send us sensitive personal information through our website unless we specifically request it.
